Sony’s DualShock Controller Infringes on Patent
3/14/2006, 1:04am Eastern Time
Nintendo has incorporated rumble technology into its controllers since the Nintendo 64 without incident. Sony, on the other hand, is experiencing a few problems.
Sony lost an appeal of a previous court ruling in a lawsuit against Immersion Corporation, a maker of tactile and haptic technology often used in game controllers. This upholds the original judgment, which ordered Sony to pay Immersion $91 million as a result of patent infringement involving Sony’s DualShock controller.
The ruling also calls for Sony to stop selling PlayStation systems, DualShock controllers and 47 games which infringe on Immersion’s patents. "Immersion is built on a strong foundation of innovative technology and intellectual property," said Immersion CEO Victor Viegas following the initial ruling in March of 2005. "We will also continue to vigorously defend our intellectual property for the benefit of our licensees and shareholders."
Sony has yet to respond on how they will handle the decision. Sony could pay Immersion a licensing fee to continue selling their products ruled to be a patent infringement. During the appeals process, Sony paid a fee to Immersion at a lower rate than Immersion usually charges.
Of the “Big Three” console makers, only Nintendo has avoided litigation with Immersion. Microsoft, facing a lawsuit similar to Sony’s, settled out of court and now officially licenses the technology from Immersion for both the original Xbox controller and the revised Controller S.
